Applied Marketing Science, Inc. (AMS) Principal and Testifying Survey Expert Brian M. Sowers guest lectured at the University of Pennsylvania Carey Law School on January 27, 2026, as part of Professor Joel Steckel and Professor Jennifer Rothman’s Marketing Research in IP and Media Litigation class.
Brian shared his expertise in survey research with Carey Law School students, offering a focused exploration of genericness surveys in Lanham Act matters. Brian’s lecture examined the Teflon and Thermos survey formats, highlighting important methodological considerations, best practices, and appropriate use cases for each survey format.
Students gained real-world insight into the applications of survey evidence in trademark and intellectual property matters, as well as key considerations when working with a survey expert.
Brian serves as a testifying expert at AMS and has submitted reports to Federal and State Courts, as well as the Trademark Trial and Appeal Board, in a variety of litigation matters. He provides survey evidence and expert testimony on matters related to trademark and trade dress infringement, among other types of litigation. He currently serves as an editor for The Trademark Reporter, and previously served on the Famous and Well-Known Marks Committee of the International Trademark Association (INTA), chairing its Dilution Subcommittee.
